Discover Blairgowrie Marketplace - Customer Terms and Conditions

Introduction
These Terms cover your use of the Discover Blairgowrie Platform Marketplace and extend the general Platform Terms and Conditions and should be read in conjunction with them. Please read these Terms carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms, please do not use the Platform. The Platform is provided to you free of charge for your personal use subject to these Terms. By using the Platform you agree to be bound by these Terms.
Amendments to Terms and Conditions
We may update these Terms from time to time and we will notify you of any changes by the e-mail address provided by you on registration. The changes will apply to the use of the Platform after we have given notice. If you do not wish to accept the new Terms you should not continue to use the Platform and the Online Stores. If you continue to use the Platform after the date on which the change comes into effect, your use of the Platform indicates your agreement to be bound by the new Terms.
Discover Blairgowrie Marketplace Introduction
The Discover Blairgowrie Marketplace has been created to support our local growers, producers and businesses by offering them the ability to sell their products online through our Marketplace. You should refer to our list of sellers and conditions of sale as they will also apply to these terms and conditions of items purchased through the marketplace.
Marketplace Operation
The Marketplace will operate by opening for orders on a set date, closing for orders on a set date and a delivery/collection date will all be set prior to the market opening:
- Marketplace will 'open' for orders on a specific date
- Marketplace will close for orders on a specific date
- A delivery and collection date will be advertised for each specific market
- Customers can place orders for products as required and complete the purchase whilst the market is 'open'
- Sellers will deliver their items ordered in the morning of the delivery/collection day
- Customers will collect their orders in the afternoon of the delivery/collection day
The process will include reminder notifications, order details, delivery details and collection details to aid with the smooth running of the market.
The Customer ("you")
In order for you to shop on Marketplace, you must:
- Register an account on the platform
- Use a payment method which is accepted in the Platform and is in your name or you have permission to use
The Sellers
When you purchase products on the Marketplace, you enter into a contract with the seller which is governed by the Marketplace - Sellers terms and Conditions, and so the seller is responsible for:
- Providing full and accurate information about their products
- Determining the price of the product including relevant taxes etc
- Supplying you with their products that you purchase
- Dealing with any issue or complaints that you may have in relation to the product
When purchasing, you enter into a contract with the sellers of the products when you place an order on Marketplace and when that order has been accepted by the seller. Your order has been accepted by the seller when BRDT sends you a notification from the Platform that your order is ready for collection.
Marketplace order terms and conditions should be read and understood and, by placing an order, you confirm that you accept these terms and conditions.
Sellers are responsible for providing the products you order and the contract for that product is between you (the Customer) and the seller.
Any questions, issues or complaints about a product should be passed to BRDT who will pass onto the seller and BRDT will facilitate.
Placing an Order
You should follow the usual steps when browsing an online store including viewing products, details and prices and add items to your cart as required. You can add products from multiple sellers to your cart without the need for separate orders.
Part of the process will include the details of when the market is 'open' and when it closes and when the collection day and time is - you should ensure you understand and accept these before completing your order.
In the order summary page, you will see the details and price of each item in your cart along with the collection day and time information.
Payment for your order will be processed immediately by BRDT via our Stripe Connect account which will then send your money to the relevant sellers but will not share your card details with BRDT nor the seller.
When payment has been made and you complete your order via the checkout process, you will receive an order confirmation detailing the products ordered, the price paid and details of the collection day and time.
The products and orders are sold and fulfilled by the Seller and all orders are subject to availability.
Delivery and Collection
Sellers are responsible for delivering their products to BRDT for your collection - the day, time and location for collection will be notified during each market and on your orders and reminders to collect. When you collect your order, we will ask you to sign to say you accept the order and the condition you receive it, and all products are satisfactory a the time of collection.
The Marketplace is run by BRDT as a local Development Trust and Charity and we ask customers to bear this in mind when placing an order. Normal rules for distance selling will apply, however, when ordering food and date sensitive items, returns are not included unless items are faulty.
Prices and VAT
The price of each product on Marketplace is set by the seller and do not include delivery charges.
All prices include VAT where applicable.
Payment
All transactions on Marketplace are paid in GBP and can be paid via Visa, Mastercard, Maestro, Visa Debit (credit and debit card payments). Transactions on Marketplace cannot be paid via American Express nor in foreign currency.
BRDT's liability
